What good is a judgment if you can't collect it? Even if a judge decides that the other party owes you money, you still have to collect the judgment. That can be very difficult. It takes a lot of investigation and creativity, and a thorough understanding of the procedural rules for collecting judgments. Since the judgments I often obtain for my clients are against businesses, the challenge is in collecting a judgment against a business that is often out of business, or is not doing well. My clients want me to undertake the collection on a contingency fee basis. That means that I get paid a portion of what I collect. If nothing is collected, nothing is owed. Sometimes pursuing a collection takes me into the Bankruptcy Court to protect my client's creditor's rights. The process involves a great deal of research and persistence.
